Welcome to bagsbuddies.org, operated by the Captain John “Bag” Hefti Memorial Scholarship Foundation, doing business as Bag's Buddies (“we,” “us,” or “our”). By accessing or using our website, making a purchase, or making a donation, you agree to these Terms of Service. If you do not agree, please do not use our website.

About Bag's Buddies

Bag's Buddies is a 501(c)(3) nonprofit organization (EIN: 87-2984176) based in Virginia Beach, Virginia. Our mission is to support youth athletes through scholarships, sports grants, and community programs that honor the legacy of Captain John “Bag” Hefti, U.S. Navy.

Purchase Terms

All merchandise sold through our online store directly supports the Bag's Buddies scholarship and grant programs. By making a purchase, you acknowledge that:

  • Proceeds from merchandise sales fund our 501(c)(3) mission, including scholarships for Virginia Beach student-athletes and youth sports grants
  • Product availability is subject to change without notice
  • Prices are listed in U.S. dollars and include applicable fees at checkout
  • We reserve the right to refuse or cancel orders in cases of pricing errors, suspected fraud, or other issues
  • Product images, including AI-generated lifestyle photos, are for illustrative purposes and may differ slightly from the actual product

Shipping Policy

  • Free shipping on all orders within the contiguous United States
  • Estimated delivery: 7 to 14 business days from the date your order is shipped
  • Orders are typically processed within 3 to 5 business days
  • You will receive an email confirmation when your order ships, including tracking information when available
  • We are not responsible for delays caused by shipping carriers or circumstances beyond our control

Returns and Refunds

We want you to be happy with your purchase. If you are not satisfied, you may request a return or exchange under the following conditions:

  • Requests must be made within 30 days of delivery
  • Items must be unused, unwashed, and in their original condition
  • Contact us at info@bagsbuddies.org to initiate a return
  • Refunds will be issued to the original payment method within 10 business days of receiving the returned item
  • We reserve the right to refuse returns that do not meet the above conditions

Donations

Bag's Buddies is a registered 501(c)(3) nonprofit organization (EIN: 87-2984176). Donations made through our website are subject to the following terms:

  • Tax deductibility: All donations are tax-deductible to the full extent allowed by law. You will receive an email receipt for your records.
  • One-time and recurring gifts: You may choose to make a one-time donation or set up a recurring monthly contribution at checkout
  • Processing fee coverage: You may optionally choose to cover payment processing fees so that 100% of your intended gift reaches our programs
  • Refund of donations: Donation refunds are handled on a case-by-case basis. Contact us within 30 days if you believe a donation was made in error.
  • Use of funds: Donations support our scholarship awards, youth sports grants, community events, and operational expenses necessary to fulfill our mission

Payment Processing

All payments are processed securely through Stripe, a PCI DSS Level 1 compliant payment processor. Your credit card information is transmitted directly to Stripe using industry-standard encryption and is never stored on our servers. By submitting payment, you agree to Stripe's Terms of Service.

Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, the Bag's Buddies brand, and the “Play Hard, Have Fun, Same Team” tagline, is the property of the Captain John “Bag” Hefti Memorial Scholarship Foundation and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission, except for personal, non-commercial use such as sharing information about our mission.

User Conduct

When using our website, you agree not to:

  • Use the site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or data
  • Submit false or misleading information in orders, donations, or applications
  • Interfere with the proper functioning of the website

Scholarship Applications

Scholarship applications submitted through our website are subject to review by the Bag's Buddies Scholarship Committee. By submitting an application, you agree that:

  • All information provided is truthful and accurate
  • We may verify academic, athletic, and other claims with third parties
  • Selection decisions are final and at the sole discretion of the Scholarship Committee
  • If selected, your name and photo may be used in promotional materials with your consent

Limitation of Liability

To the maximum extent permitted by law, Bag's Buddies and its officers, directors, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, purchases, donations, or participation in our programs.

Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

Indemnification

You agree to indemnify and hold harmless Bag's Buddies, its officers, directors, volunteers, and agents from any claims, damages, losses, or expenses arising from your use of the website or violation of these Terms.

Governing Law
